Privacy Policy

Shoutbomb, LLC (referred to as “Shoutbomb,” “us” or “we”) recognizes that your privacy is important. This Privacy Policy (“Policy”) discloses the privacy practices for the Company, and also covers how personal and other information that we receive or collect from customers/patrons (collectively referred to as “you”) is treated.

  1. Types of Information We Collect

During the provision of our services to you, we may collect information about our clients and their customers, including Personally Identifiable Information (“PII”). Personally Identifiable Information (“PII”) refers to information that lets us know the specifics of who you are. Examples of PII may include: your first and last name, email address, telephone number, library card number, and library card PIN (personal identification number). You may also voluntarily provide other PII, whether or not specifically requested by us, by voluntarily supplying your own details to us via email, text, or internet form submission. You agree that we may collect any PII voluntarily supplied by you, whether or not we have requested it. You must not submit any PII relating to a third party which you do not have permission from such third party to provide to us. We do not knowingly collect any information relating to third parties which you do not have permission to provide. When you contact us directly, such as sending us a message or written content via email or text or internet form submission, we may ask you to provide certain PII.

  1. How We Collect and Use Information

We do not directly collect any PII about you unless you voluntarily provide it to us. However, you may be required to provide certain PII to us when you elect to use our services and/or contact us directly. We only use PII to facilitate and provide services to our customers.

  1. Information Sharing and Release

We do not allow outside parties to collect PII about you or your patrons. We do not share PII with any third parties.

We will provide PII if required to do so by law enforcement, judicial, and/or other governmental authorities. In such cases, we will disclose PII to comply with the law, applicable regulations, governmental and quasi-governmental requests, court orders or subpoenas, to enforce our agreements, or to protect our rights, property, or safety or the rights, property, or safety of our users or others (e.g., to a consumer reporting agency for fraud protections, etc.). We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.

If we become involved in a merger, acquisition, or other transaction involving the sale or transfer or some or all of our assets, your information including PII could be included in the transferred assets. You expressly consent to such transfer. Should such an event occur, we will use reasonable means to notify you, either through mail or email.

  1. Security of Your PII

We strive to take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of your PII. For example:

— We work hard to ensure that the data we collect is reliable, accurate, complete, and current. We use PII only for the purposes for which it was collected or to comply with any applicable legal or ethical reporting or document retention requirements.

— We limit access to PII only to specific employees, contractors, and agents who have a reasonable need to come into contact with your information.

— Additionally, we also employ a number of physical, electronic, and procedural safeguards to protect PII. Our secure servers and our data centers are protected by encryption, and our servers reside behind firewalls and password protection.

— We provide secure TLS/SSL connections and encryption for PINs in our database. All data, PII, and/or other information is deleted after our services are completed.

Unfortunately, no data transmission over the internet or any wireless network can be guaranteed to be 100% secure. While we make every effort to protect your PII, (a) there are security and privacy limitations inherent to the internet that are beyond our control; and (b) the security, integrity, and privacy of any and all information and data exchanged between you and us through internet transmission cannot be guaranteed.

  1. Children’s Privacy

We do not knowingly collect personal information from children and our services are not directed toward children under the age of 13.

  1. Your California Privacy Rights.

California residents are permitted under California law to re quest information about the manner in which we share certain categories of information with others for their marketing purposes. Specifically, California Civil Code Section 1798.83, known as the "Shine the Light" law, requires us to provide to you upon your request: (a) a list of your personal information, if any, which we have disclosed to third parties for direct marketing purposes in the preceding calendar year; and (b) the names and addresses of those third parties. You may make such a request once per calendar year, and we will provide the information to you free of charge. However, as defined under Section 1798.83, we do not share any personal information with third parties for their direct marketing purposes.

  1. No Rights of Third Parties.

This Policy does not create rights enforceable by third parties or require disclosure of any personal information relating to users.

We reserve the right to change this Policy from time to time. We will notify you about significant changes in the way we treat personal information by updating this privacy policy and providing it to you while any contracts with us are pending and/or active, or upon request.
